Terms of service

These Terms of Service ("Terms") govern your access to and use of our website and services. By accessing or using our website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our website.

1. Overview

Inner Bloom Dispensary ("we", "our", or "us") operates an Australian-based online dispensary that supplies practitioner-grade supplements and custom-formulated liquid herbs to qualified naturopaths, nutritionists, and final-year students in clinical placement. Our products are intended for professional use only and are not directly available to the general public.

Our platform also enables practitioners to prepare a prescription or formula for one of their patients and to send that patient a payment link, through which the patient pays for the prescription directly (a "patient payment"). Where this occurs, the patient pays through a white-labelled payment portal that operates under the practitioner's care; the patient transacts on the basis of their relationship with their practitioner. The way these patient payments work is set out in Section 6 (Patient Payments).

2. Eligibility

By using our website, you represent and warrant that:

  • You are a registered and qualified naturopath or nutritionist, or a final-year student in clinical placement.
  • You are at least 18 years old and have the legal capacity to enter into binding contracts.
  • You will use our products in accordance with applicable laws and regulations, as well as any manufacturer policies. For final-year students this means for personal consumption only.

This eligibility requirement applies to practitioners and students who hold accounts and use our platform directly. It does not apply to a patient who simply pays for a prescription their practitioner has prepared for them (see Section 6).

3. Account Registration

To purchase products from our website, or to prepare prescriptions and send patient payment requests, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Product Orders

Order Acceptance: All orders are subject to acceptance by Inner Bloom Dispensary. We reserve the right to refuse any order at our discretion.

Order Processing: Due to the custom nature of our products, processing times may vary. We will provide estimated shipping times but cannot guarantee delivery dates.

Pricing: Prices are subject to change without notice. The price applicable to your order will be the price at the time of purchase.

5. Payments

Payment Methods: For practitioner orders, we accept various forms of payment including card payments, bank transfer, and PayID. Card payments for practitioner orders are processed through our website's payment provider (Shopify). Patient payments are processed separately as described in Section 6. Payment must be received before products are shipped.

Billing Information: You agree to provide accurate billing information and authorise us to charge the specified payment method for the total amount of your order, including any applicable taxes and shipping fees.

Currency: All prices and transactions are in Australian Dollars (AUD).

6. Patient Payments

In addition to ordering products directly, a practitioner may prepare a prescription or formula for one of their patients and send that patient a request to pay for it. The following terms apply to those patient payments.

The practitioner's role. The practitioner is responsible for the clinical decision to prepare the prescription or formula, for the appropriateness of the products selected, and for their relationship with the patient. The practitioner determines the amount payable by the patient (which may include the practitioner's own professional fee or margin) and is responsible for communicating with their patient about the prescription, the amount payable, and any questions or concerns the patient may have.

Our role. We supply and dispatch the product and facilitate the collection of the patient's payment through a white-labelled payment portal. We do not provide clinical or health advice to patients, and we do not have a direct treating relationship with the patient. The patient's relationship is with their practitioner.

The amount payable. A patient who is sent a payment request pays the total amount presented to them through the payment link. That amount reflects the price set in connection with the practitioner's prescription, including any professional fee or margin the practitioner has applied. By proceeding with payment, the patient agrees to pay that total.

How patient payments are processed. Patient payments are processed by our third-party payment processor (Stripe). Patients provide payment and delivery details necessary to complete the transaction and to ship the product. We do not store full card numbers on our systems.

Patient enquiries, returns, and issues. Because the patient's relationship is with their practitioner, a patient with any question, concern, return request, or issue relating to their prescription, payment, or delivery should contact their practitioner in the first instance. The practitioner is the patient's point of contact. The returns and refunds position in Section 7 applies to patient payments in the same way it applies to practitioner orders (in particular, the custom-product position), subject to any non-excludable rights described in Section 7.

Practitioner authority and consent. A practitioner who prepares a prescription for a patient and sends a payment request represents and warrants that they have the patient's authority and consent to do so, to provide the patient's information to us for the purpose of dispensing and delivery, and for that information to be handled in accordance with our Privacy Policy. The practitioner is responsible for ensuring this authority and consent is in place.

7. Returns and Refunds

Custom Products: Due to the personalised nature of our products, we do not accept returns, provide refunds, or offer exchanges. Please ensure items and quantities are selected carefully. This applies to both practitioner orders and patient payments.

Pre-Processing Cancellations: If an order needs to be cancelled and it has not yet been processed, please contact us (for practitioner orders) or your practitioner (for patient payments) immediately. We may be able to provide a refund if the order has not entered the production stage.

Damages and Issues: If a damaged or incorrect product is received, the practitioner should contact us immediately (or, for a patient payment, the patient should contact their practitioner, who will raise the matter with us). We will assist in resolving the issue, including working with Australia Post if necessary.

Your rights under the Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded. Where our goods come with guarantees that cannot be excluded under the Australian Consumer Law, our liability for failing to meet those guarantees is limited to the extent permitted by that law. The "no returns / no refunds" position above applies only to the extent permitted by applicable law and does not limit any non-excludable rights.

8. Shipping and Delivery

Shipping: We ship Australia-wide using Australia Post. Shipping costs and delivery times are provided in our Shipping Policy and calculated at checkout. These costs may vary based on order size. For patient payments, the product is shipped to the delivery address provided in connection with the patient's payment.

Risk of Loss: Once the order is handed over to Australia Post, the risk of loss passes to the recipient. We are not responsible for delays or damages caused during shipping, except to the extent required by applicable law (see Section 7).

9. Use of Products

Our products are intended for use by qualified naturopaths and nutritionists, and their prescribed patients. Final-year students can only use our products for personal consumption and are not permitted to prescribe or order for other individuals. You agree to use our products in accordance with professional standards and applicable laws. We are not responsible for any misuse of our products. The clinical appropriateness of any prescription or formula prepared for a patient is the responsibility of the prescribing practitioner.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Inner Bloom Dispensary or its licensors and is protected by Australian and international copyright laws. You may not use, reproduce, or distribute any content without our express written permission.

11. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect personal information, including the information practitioners provide to us about their patients.

12. Limitation of Liability

To the fullest extent permitted by law, Inner Bloom Dispensary shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or products. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

We are not responsible for the clinical decisions of a practitioner, for the practitioner's relationship with their patient, or for the amount a practitioner chooses to charge a patient. Nothing in this Section limits any rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable law (see Section 7).

13. Indemnification

You agree to indemnify and hold harmless Inner Bloom Dispensary, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of our website or products, your breach of these Terms, or — in the case of a practitioner — any prescription you prepare, any amount you charge a patient, or any claim by a patient arising from your relationship with them.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Queensland for the resolution of any disputes.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website following the posting of changes constitutes your acceptance of those changes.
